If You Have Had Or May Need Knee Surgery From Your New York State Workers’ Compensation Case…
by Paul Giannetti (Paul Giannetti Attorney at Law)If you have suffered a work related injury to your knee and have undergone knee surgery or may need knee surgery in the future, you should be aware that you may qualify for a permanency award.
You don’t necessarily need to have an operation on your knee for permanency to attach. However, if you have surgery there is a higher likelihood that you will qualify for a permanency award.
In knee cases, you should receive your lost wages during your period of disability. After you have returned to work and a year has past from the date of the surgery, you may qualify for what is known as a schedule loss of use award. This is a monetary award that may be payable based upon the severity of your loss of motion which has resulted from your injury at work.
Schedule loss of use awards, in certain circumstances, can represent a significant cash payment and many claimants are unaware that they may be entitled to this award.
